1) I do hereby request and consent to be tattooed by Canvas Cultique. While Canvas Cultique endeavours to practice the highest health and safety measures and has provided me with information regarding the healing process, infection control, aftercare, and possible side-effects, they cannot be held liable for any harmful consequence arising from the tattoo process or from the tattoo artist.
2) I do hereby irrevocably indemnify and hold harmless Canvas Cultique including its employees, agents, predecessors, successors in title and assigns against all and any present, past and future actions, suits, proceedings, claims, demands, costs and expenses of whatsoever nature and howsoever incurred which may be taken or made against it by any persons or party whomsoever, or be incurred or become payable by it pursuant and/or arising out of the tattooing process, the tattoo itself, or the inks/materials used.
3) I warrant that I am at least 18 years of age and have the necessary legal capacity to enter into this agreement or alternatively I am assisted herein by my parent or guardian, who has consented hereto and has signed this agreement together with me in the presence of a Canvas Cultique employee.
4) I warrant that I have the right to have the selected design tattooed upon my body, and Canvas Cultique will not be held liable for any claim in respect of the infringement of any copyright or trademark.
5) I agree not to hold Canvas Cultique liable for any complications or side-effects, whether immediate or delayed, acute or chronic or any costs related thereto. Such complications or side-effects may include, but is not limited to the scarring, including granuloma; keloid scarring; cracking; peeling and/or blistering pain; suffering and discomfort; infection and/or discharge; swelling scabbing; rash or redness; excessive or prolonged bleeding; skin irritation; rejection; allergic reaction; poisoning; any disease, viral or bacterial infection of whatsoever nature; alternatively, any other injury.
6) I have made my tattoo artist aware of any relevant medical conditions.
7) I agree not to hold Canvas Cultique liable for any damage or theft to personal property while on the premises.
8) I agree not to hold Canvas Cultique liable for any monetary loss that may arise, whether directly or indirectly, which loss shall include, but shall not be limited to medical costs, loss of income and/or loss of revenue.
9) I agree not to hold Canvas Cultique liable should I not be satisfied with the tattoo for any reason, including but not limited to any variation of design, size, quantity, placement, colouring, symmetry, proportion, and/or any spelling, grammar, translation, or punctuation.
10) I agree not to hold Canvas Cultique for any smudging, stretching, or fading that may occur, whether immediate or over time.
11) I acknowledge that I am not under the influence of any alcohol or narcotics at the time of my appointment.
12) I understand that Canvas Cultique are not medical professionals and are not qualified to diagnose medical conditions or give medical advice.
13) I hereby give Canvas Cultique permission to take photographs or film any part of the tattoo and give my permission for them to use these photographs and/or videos in any way the deem fit.
14) I understand that any tattoos done on my hands, fingers and feet will not be applicable for a complimentary touch up. All touch ups done to these tattoos will be charged for in full.
